  • I. How we collect and use information – APUS Launcher

    • Read phone status and identity

      We may read the unique device ID and encrypt irreversibly while will not collect user personal identity information.

    • Read your text messages (SMS or MMS)

      Used to search messages in phone. No relative information will be collected.

    • Take pictures and videos

      Used in APUS Settings and toolbar to turn on/off flashlight.

    • We may get your approximate location (network-based)

      Used in APUS Discovery to recommend popular apps for users around you.

      Used in APUS Know to provide taxi service for users.

      Used in Weather function to provide weather information service.

    • We may read your contacts

      Only used in contact search as you required. No relative contact information will be collected.

    • Read calendar events and relative information

      Only used in APUS Know to display recent calendar events. No relative calendar information will be collected.

    • Modify or delete the contents of your USB storage

      This permission allows users to delete APUS wallpapers stored in SD card.

    • Read the contents of your USB storage

      This permission allows users to view APUS wallpapers stored in SD card.

    • Set an alarm

      By tapping the clock widget, allow user to enter Alarm settings.

    • Find accounts on the devices

      This permission allows APUS to check if users have logged in Google Play and provide relative app installation service.

    • Read Google service configuration

      This permission allows APUS to read ad ID and provide ad recommendation service.

    • Change cellular data status

      Used in APUS Settings and tool bar to turn on/off cellular data.

    • Change Wi-Fi connection status

      Used in APUS Settings and tool bar to turn on/off Wi-Fi connection.

    • Full network access

      This permission accesses APUS to network for achieving relative services, e.g. providing version update notification, sorting configuration of smart folder, news, etc. Data consumption may be needed.

    • Check network connections

      Used in APUS Settings and tool bar to check network connection status.

    • Check Wi-Fi connections

      Used in APUS Settings and tool bar to turn on/off Wi-Fi connection.

    • Access Bluetooth settings

      Used in APUS Settings to turn on/off Bluetooth.

    • Pair with Bluetooth devices

      Used in APUS Settings to view Bluetooth connection status.

    • Close other apps

      This permission allows APUS to close apps running in background with 1-Tap Acceleration, System Master and APUS Booster.

    • Retrieve running apps

      This permission allows APUS to check running apps with 1-Tap Acceleration, System Master and APUS Booster.

    • Run as startup

      This permission allows APUS services to run at startup.

    • Draw over other apps

      This permission allows Free Swipe to display windows over other apps.

    • Control vibration

      Used in APUS Settings so device can vibrate for once as notification when startup.

    • Adjust your wallpaper size

      This permission allows users to adjust wallpaper size.

    • Set wallpaper

      This permission allows users to choose and set wallpapers and Linked wallpapers.

    • Read sync settings

      Used in APUS battery saver mode, check status of sync settings to save power.

    • Toggle sync on and off

      Used in APUS Battery Saver Mode to toggle on/off sync.

    • Expand/collapse status notification bar

      Used to expand/collapse status notification bar, for launcher gesture operations.

    • Install shortcuts

      This permission allows APUS to create shortcuts on other launchers and users can continue to use APUS relative functions.

    • Measure app storage space

      Used in app management to view memory usage by apps.

    • Modify system settings

      Used in APUS settings to toggle or adjust ringtone, vibration and brightness.

    • Read Home settings and shortcuts

      Used to read settings and shortcuts of precious home launcher for better adaptability.

    • Uninstall shortcuts

      This permission allows user to delete APUS shortcuts created on other launchers.

    • Read call log

      This permission allows APUS read call log to notify missed calls and recommend contacts. No relative information will be collected.

    • Receive data from the internet

      This permission allows APUS to use internet data to update information for users.

    • Precise location (GPS and network-based)

      This permission allows APUS to use location service to provide weather information for users. This may consume more battery.

    • Manage Bluetooth

      Used to access Bluetooth settings and pair with other devices via Bluetooth.

    • Read, modify and delete contents in the SD card

      This permission allows APUS to read, modify and delete contents in SD card according to user’s order.

    • Reroute outgoing calls

      This permission allows user to read and call back missed calls.

    • Install shortcuts

      This permission allows user to create APUS shortcuts on launcher home.

    • View or change system settings

      This permission allows APUS Settings to view and change settings of ringtone, vibration, screen rotate, and brightness.

    • System alert window

      Used to send instant notifications to users by drawing over other messages.

    • Access to widgets

      This permission allows users to add and display widgets of Android system and other apps on APUS Launcher.

    • View recently used apps

      Used for app arrangements on APUS Launcher home. No relative information will be collected.

      Used for recently used apps in All Apps, Free Swipe, APUS Search. No relative information will be collected.

    • Read weather widget data

      This permission allows APUS launcher to display weather widget appropriately with mobile devices.

    • Apply for GCM service

      Used in Linked Wallpaper to send initiation via GCM service.

      Used in Daily News release.

    • Apply for notification access

      Used in 1-Tap Acceleration to clear useless notifications chosen by users.

    • Accessibility

      This permission allows APUS Booster to close apps chosen by users with accessibility. This permission is only used to speed up device and no other personal information will be collected.

    • Awake in background

      Used in Lock screen to activate 1-Tap Acceleration, close unnecessary apps running in background and save battery power.

  • II. How we protect your information

    We will use commercially and technically reasonable means and efforts to properly arrange and protect your information, for example, to protect through use of newer asymmetric encryption techniques, to hold your personal information harmless from accidental loss, misuse, alteration, destruction, unauthorized access and disclosure, and so on. Except as required by law or expressly allowed herein, we will not disclose your personal information:

    • For legal reasons

      To disclose your information as required by law or administrative regulations, or the disclosure is necessary to comply with legal procedure served on APUS websites;

    • With your consent

      To disclose your information with authorization or consent given by yourself;

    • We may get your location (GPS and network-based)

      This permission allows APUS Browser provide weather service. Also, some websites want to know your location so that they offer better service according to your location. You can still decline them in pop-up window or clear them in settings. This information can’t be traced back.

    • Read, modify or delete the contents of your USB storage as your instructions

      We use this permission so that you can download pictures, videos, music etc. to your SD card.

    • Full network access

      We use this permission so that you can search and load web pages. It's a basic feature for browser.

    • View network connections

      This permission is used for smart download according to network connection status.

    • Prevent Phone from sleeping

      The only purpose for using this permission is to prevent the phone from going to sleep when you are playing videos in full screen mode, otherwise we won't do it .

    • Read phone status and identity

      This permission allows APUS Browser to smartly recommend News and other content to users. It does not require any user personal identified information.

    • Read browser bookmarks

      This permission allows APUS Browser to import other browsers’ bookmarks.

    • Draw over other apps

      This permission allows the APUS Browser to display a floating window on other apps so that browser can quickly search your copied texts.

    • Run as startup

      APUS Browser will run at startup to provide users with services.

    • Install shortcuts

      This permission is used to install shortcuts on launchers, so users can continue using APUS Browser related function.

    • Modify system settings

      This permission is used to switch or adjust volume and brightness level of the screen for video playing.

    • Receive GCM notification

      This permission allows users to receive GCM notification for subscription services.

    • Retrieve device information and running apps

      i) When you use service or view contents provided by APUS Message Center, APUS will automatically collect and store some information in server log, including:

      • Detailed service usage, e.g. log of operation in APUS Message Center.
      • Device log, e.g. crash, system activity, hardware configuration, IP address, requested date and time.

      ii) To provide message notification and display service, APUS Message Center will retrieve running apps.

    • Find accounts on the device

      Used for email address in Feedback as user instructions. No relative information will be collected without permission.

    • Read your contacts

      Used to send SMS to contacts chosen by users. No contact identified information will be collected.

    • Send and view SMS

      Used in messaging service in APUS Message Center, including create, reply, and forward SMS. No Message content will be collected.

    • Read call log

      Used in phone call service in APUS Message Center, including display phone number and time of missed calls, and users can spontaneously change status of missed calls. No calls information will be collected.

    • Files Storage - read, edit or delete the cache data of your USB storage as your instructions

      Used to write, edit cache data and delete as user instructions.

    • Network connections - check network connections and full network access

      Only used to upload and analyze statistics of user operations, which are used to optimize APUS products.

    • Control vibration

      This permission allows APUS Message Center to control vibration and notify new messages.

    • Notification and status bar access

      i) This permission allows APUS Message Center to read notifications of other apps and notify in status bar

      ii) Allow adding message to status bar

      iii) This permission allows APUS Message Center to expand/collapse status bar, and notify new messages in status bar.

    • Other

      i) Run at startup - This permission allows APUS to run at startup.

      ii) Gmail - Retrieve number of unread emails.

      iii) Draw over other apps - Draw over other apps to notify new messages.

      Used in our junk files cleaning feature to scan junk from device’s hard drive.

      Used in our junk files cleaning feature to remove junk from device’s hard drive.

    • Find accounts on the device

      Used to check if user has logged in to Google Play, and provide the corresponding installation and download services.

    • Read Google service configuration

      Used to retrieve anonymous advertising ID so as to provide high-accuracy advertising recommendation service.

    • Full network access

      Used to achieve network-based services, e.g. performing version update notification. GPRS traffic may be needed.

    • Check network connections

      Used in our smart settings and quick access function to check network connections.

    • Modify network connectivity

      Used to support battery saver feature to control and adjust vibration, screen rotation and screen brightness, and we may use this permission to read device’s default input method.

    • Use of system-level dialog

      When providing app lock feature, this permission is needed to monitor the app that is currently displayed on the platform.

    • Retrieve recently used applications

      When providing app lock feature, this permission is needed to monitor the app that is currently displayed on the platform.

    • Use of Accessibility Service

      Used in APUS Booster to close the apps selected by user. This permission is only used to phone’s speedup and no other information will be collected.

    • Delete system’s cache

      Used to provide junk files cleaning feature with removing system’s cache data.

  • II. How we protect your information

    We will use commercially and technically reasonable means and efforts to properly arrange and protect your information, for example, to protect through use of newer asymmetric encryption techniques, to hold your personal information harmless from accidental loss, misuse, alteration, destruction, unauthorized access and disclosure, and so on. Except as required by law or expressly allowed herein, we will not disclose your personal information:

      To disclose your information as required by law or administrative regulations, or the disclosure is necessary to comply with legal procedure served on APUS websites;

YOU CAN CHECK THE MODIFIED VERSION FROM THE SOFTWARE OR THE OFFICIAL WEBSITE.       When user recommends friends to download APUS Flashlight by sharing to social network, we need to save an introduction picture to be shared on SD card. We won’t access other file on SD card.

      We use these permissions to determine network status, and collect basic anonymous APUS Flashlight usage data.

    • Device ID & call information

      Read phone status and identity

      The only purpose using this permission is to stop cleaning operation while receiving incoming call, for preventing phone call being interfaced.

      Control vibration

      We use these permissions to provide many useful features, like vibrating when user turns on/off flashlight, displaying operation instruction on other apps, preparing flashlight for use when android reboot.

    We have implemented commercially reasonable technical and organizational measures to protect your personal information from accidental loss and from loss, misuse and unauthorized access, disclosure, alteration and destruction. However, please note that although we take reasonable measures to protect your information, no app, website, Internet transmission, computer system or wireless connection is completely secure.

  • Limitation of Liability

    YOU EXPRESSLY UNDERSTAND AND AGREE THAT APUS FLASHLIGHT AND ITS AFFILIATES, SUBSIDIARIES, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THE BREACH OF THE TOS OR THE USING OF SERVICE, EVEN IF APUS FLASHLIGHT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  • Indemnification

    You agree to indemnify and hold APUS Flashlight and its affiliates, subsidiaries, employees and agents harmless from and against any third-party claim and any related losses, costs, liabilities and expenses, including reasonable attorneys’ fees, arising out of the breach of any representations, warranties or covenants made by you.

  • Governing Law and Disputes Resolution

    Except to the extent that: (i) any applicable additional terms incorporated into these Terms provide differently, or (ii) the applicable laws and regulations of your jurisdiction mandate otherwise, the TOS and any dispute or claim arising out of or in connection with the TOS will be governed by the laws of the People’s Republic of China.

    Any dispute, controversy or claim (whether in contract, tort or otherwise) arising out of, relating to, or in connection with the TOS, including their existence, validity, interpretation, performance, breach or termination, will be referred to and finally resolved by arbitration administered by the China International Economic and Trade Arbitration Commission (CIETAC), and the place of arbitration shall be in Beijing. Within the valid period for the arbitration, such arbitration tribunal shall subject to the arbitration rules of the CIETAC in effect at the time of the arbitration. The award of the arbitration tribunal shall be final and binding upon the two parties.
